Welcome to our terms and conditions. Not a ‘wow’ but nonetheless important to understand in our mutual relationship, so we’ve aimed to make them as clear and readable as possible and in plain English.

collectively known as the “Website” are owned and operated by Tara Springs Pty Ltd (ACN 635 169 416), also trading as Jane Mallick Yoga and Glenn Polley Shiatsu.

This document sets out the Terms and Conditions you need to be aware of when accessing and browsing the Website, visiting Tara Springs Retreat Centre in person, entering into any rental agreement or purchasing any course from us. Please take a moment to read it, as it sets out the terms of our relationship so that we may mutually benefit from having a really clear understanding of the boundaries around what we offer and knowing what we may expect from each other. 

When you visit the Website, enter into a rental agreement or purchase our courses, you agree that you are over the age of 18 and willing to be bound by these Terms & Conditions. If you do not agree, you should discontinue visiting the Website, entering into any agreement or purchase anything from us. This is because you are still deemed to be a ‘minor’ and your parents have some legal authority to say what you can and can’t do.

All products and services advertised on our websites are offered in compliance with Australian Consumer Law.

These Terms & Conditions may be changed or modified from time to time. Please check back regularly to ensure you are aware of any changes we have made.

There may be additional, specific agreements provided to you in relation to our services and courses. If there is any inconsistency between this document and those specific terms of service, these General Terms & Conditions are overruled to the extent of the inconsistency. 

Content Disclaimer

Any content produced or delivered by Tara Springs, whether verbally, hardcopy or electronic form, including any content uploaded on our social media accounts (collectively known as Content) and on the Website is offered by Tara Springs for the purpose of sharing health and lifestyle information for the benefit of public interest.

Content Policy

We have extensive experience in our sector, undertake regular professional development and conduct ongoing professional research in order to provide Content that we believe to be valuable and true, however we take no responsibility for the use that you choose to make of that information. The Content is drawn from many sources; from our own studies, our experience and that of our clients, and from both written and web based sources, and is provided at the discretion of Tara Springs.

The Content is in no way a substitute for independent professional advice. It is not intended to be used as medical advice or to be used to diagnose, treat, cure or prevent any health condition, illness or diseases. The Content and the generalised information we provide should not be used as a substitute for specific professional health advice specific to your individual circumstances or used for your own therapeutic purposes.

While we take all reasonable care to ensure that the Content we create and share is accurate, relevant and up to date, we make no guarantees and assume no legal liability or responsibility for any inaccuracy, incompleteness or error in any of the Content we provide. There is no professional relationship formed by your visit to the Website unless you explicitly choose to work with us by purchasing any of our services or courses.

Visitor Responsibilities


You are responsible for your own safety and wellbeing while browsing the internet. We recommend you do not act on anything you read or hear without first conducting your own research, consulting appropriately qualified professionals, and making informed choices about what is right for you, based on your unique personal circumstances.

It really should go without saying, but it needs to be said that as a user of the Website, you agree not to behave maliciously, spam any other user, post defamatory content about anyone, infect any aspect of our Website with malware, hack into any part of our Website where you don’t have our permission to be, or use our Website for any purpose other than viewing our content, engaging in our courses, and purchasing our products or services. You also agree not to use our Website or Content in any way that is unlawful or harmful to any other person or business. If you do, we have the right to refuse you service and block you from accessing our Website or social media pages.


The Website may offer paid and free downloads. While we take cybersecurity seriously and make every reasonable effort to ensure these downloads are safe and hassle free, we are not responsible for any viruses or other damage which might occur as a result of you downloading material from this site. Please make your web browsing safety a priority and ensure you have adequate protection against viruses and other malicious attacks that may occur without our knowledge or consent.

Occasionally we may provide links to external sites of other businesses, either collaborating with us or using our venue. We have no control over the information provided on these sites, and the links are solely for your information and education. We do not endorse any courses, products, services or information they offer and have no relationship with them unless this is clearly stated.

In Person

You are responsible for your own safety and wellbeing while attending any in-person event and  we strongly suggest that if at any point you feel this is not the case, you immediately speak with the facilitator/s to rectify this. It is highly important that you are both attentive to, and follow all instructions given, and if they are in any way unclear to you that you ask questions to ensure you are clear before you proceed with the activity.

We recommend you ‘listen’ to your own body when undertaking any activities and do not do anything that feels in any way ‘wrong’ for you irregardless of both the instruction or what other participants are doing.

We also recommend that you do not act upon anything you see or hear on any in-person event without first conducting your own research, consulting appropriately qualified professionals, and making informed choices about what is right for you, based on your own unique personal circumstances.

Disclaimer for Services or Products 

There are a number of ways you may choose to engage with us that are available to purchase or book through the Website. The terms and conditions in this document apply to all of our services and products unless alternative terms are explicitly stated and subsequently provided to you. 

What we offer:

  • One-to-One Sessions, Classes, Workshops and Retreats

Our intention in offering these One-to-One Sessions, Classes, Workshops and Retreats (collectively known as “Event/s”) is solely for both your personal and professional education and development in order to take a more informed and proactive approach to your health and wellbeing. We seek to assist you in connecting to your own inner wisdom and knowing, in developing a deeper understanding of the mental, spiritual and emotional factors that determine health, in order to be able to ask questions and make decisions on your own health and wellbeing. Integral to our approach is an understanding that a holistic approach means that nothing is ruled in or out, and that you need to follow your own instinct and judgement  in knowing when to consult a health professional, be that complementary or mainstream.

  • Studio Hire

Our intention in offering the Studio for hire is to provide a venue for suitably qualified health professionals to offer personal and professional development courses that align with both our values and philosophical concepts of health and wellbeing. We aim to provide a safe and nurturing space to hold both your participants and yourself.

Our Responsibility

We believe it is our responsibility to conduct all Events in a safe, inclusive and ethical manner. We highly value informed  consent as the foundation to holding space for you to explore your needs. We aim to deliver what we have promised with diligence and integrity. We are committed to undertaking ongoing professional development and personal reflection to ensure we are confident that what we deliver is what we practice and is within the scope of experience as relates to our qualifications, post-graduate training and clinical experience.

  • Studio Hire

We believe it is our responsibility to ensure that the studio space is safe and compliant with all relevant Local, State and Federal Government requirements, and that we have clear policies and guidelines for its use.

What we Expect from You

Important information about how to get the most value out of working with us whilst caring for your own wellbeing is set out below. If you have any questions or concerns, please email us before proceeding with your purchasing any in-person event.

Fundamental to attendance is the importance of following  all directions, instructions  and policies connected to your participation.

We need you to be honest about both your medical, physical, mental and  emotional condition and that if you have any issues or concerns you firstly seek professional advice as to what you can or can’t do in relation to the condition/s you may have. We then expect you to be honest and open in sharing all that information with us and the event facilitator/s in order to support you navigate the event if this has been deemed to be appropriate. We then require that you take full responsibility for your actions in relation to your health and wellbeing during any activities undertaken.

In order to gain the most out of any Event, it is important that you adhere to any instructions given and take full responsibility for listening to your body and not pushing yourself beyond what is comfortable, irregardless of what is either being demonstrated or what other participants may be able to do.  If at any point you feel you are uncomfortable with what is being shown or asked of you, we strongly recommend you speak immediately with the facilitator/s before proceeding until you feel satisfied you can progress safely. Alternatively at any point during an Event you can decline from doing any activity if you are either unable to do it safely, or it is of risk to you and your condition. 

If you require medication/s it is important you disclose that information to us and that you are responsible for bringing, maintaining and using these as per the advice of your medical practitioner or pharmacist. Attending any Event is not the time to stop taking any medication/s you are on.  

Participants must not attend any Event while affected by alcohol or drugs. If you do, then it is within our rights to ask you to leave without recourse for any refund.

Important Information

Before you purchase any product from us, be it online or in-person, it is important that you are familiar with our Refund Policy (see page 9) and your obligations to disclose any information that may have a bearing upon your participation.

Risks General

In Person Events

Whilst attending any Events at Tara Springs, you are ultimately responsible for your own safety and wellbeing at all times and although this is being held and contained by all the facilitators on the Event, if at any point you feel this is not the case, you need to immediately speak with the facilitator to rectify this before continuing.

We primarily see what we are offering in our Events and Online Programs as a medium to ask deeper questions about who you are and what emotions or patterning drives who you are in the world as a means of gaining a greater sense of self understanding and self empowerment. As such, it is important to understand that by attending an In-person Event or completing an Online Program, that it may trigger an emotional reaction. We suggest that you are aware of this and factor in some time for a transition back into your normal daily life. If this happens and you do not have the emotional support, please contact us for reassurance and guidance to help you access the support you need.  

You are responsible for all travel to and from Tara Springs, and for any time outside of our structured time together, be it on or off the property. This includes camping and any free time during Events.

If you access the gardens and grounds of Tara Springs, it is important that you take appropriate precautions by ensuring you wear appropriate clothing and footwear. If walking on the property do not walk through long grass in the summer months and keep to the mown and/or designated paths. As it is a rural farm property,  there may be areas of uneven ground or holes dug by rabbits etc. along with farm and garden infrastructure, so it is important you take care in your movements. If you go through any gates, please ensure you close them after you. If you choose to visit the dam on the property, keep to the designated and mown paths and keep clear of the dam edges as they are slippery and hazardous.

Inherent on a rural farm property are a wide range of both native and introduced animals and insects. Among those are kangaroos, foxes, snakes, spiders, bees and wasps, some of which are venomous. It is highly recommended that you do not approach or seek to interact in any way with them whilst on the property for your own safety. There are also farm animals on the property including sheep, a dog, a cat, ducks, guinea fowl and chickens and likewise it is recommended that you do not approach or seek to interact in any way with them or to feed them whilst here for your own safety. 

If you need to move around the property during the hours of darkness, please ensure you have a well functioning torch to ensure your safety during those movements.

Fire Circle

The fire circle has been designed to be as safe as possible, yet fire has inherent risks associated with it. When having a fire, please firstly seek prior approval from us and secondly ensure you comply with all CFA fire restrictions. It is often not possible to have a fire during the fire season which generally runs from November until April. Be please aware of the specific fire season dates for Mt Alexander Shire as each Local Government Shire differs in their dates. 

Please ensure you are responsible for the safety of yourself and all participants around the fire pit.

Medical Conditions

If you require any medication/s,  you are responsible for bringing, maintaining and using these as per the advice of your medical practitioner or pharmacist. General first aid is only available at Tara Springs Retreat Centre.

 It is your responsibility to check with your medical practitioner that you are able to safely participate in all activities on the Event you have purchased online or booked to attend In-person.

If in-person, you can at any point in the Event decline from doing any activitie/s if you are either unable to do it, or it is of risk to you. Modifications can often be offered, but again we recommend you do not undertake it if you believe it is at risk to your health and wellbeing.

If you are taking any medication or treatments, it is important you are honest in disclosing this information and attendance in any Events is not an appropriate time to stop taking any medication. 

It is important that if anything in relation to your health changes prior to the Event, such as pregnancy or beginning a new  medication, that you inform us immediately.

General First aid only is available at the Tara Springs Retreat Centre.


Any of the information and practices we share are based on many years of personal research and practice, professional training and development, and in working with numerous individuals. This is not in any way a substitute for professional mental health support, counselling or psychotherapy, or medical advice. We are not clinically trained in these modalities, and do not offer any kind of professional western diagnoses with our  services or offerings. 

At all times, you remain fully responsible for your own physical,  emotional and mental wellbeing. It is important you are honest in disclosing all health information. 

If you are working with other health practitioners, it is important that you inform us if you believe it may impact upon your attendance in any Events, and to continue any treatment plans you are on. We are always open and happy to work collaboratively as part of your holistic health care team.

Professional Advice

If any concerns arise during our work together, we would recommend you speak to us immediately so we can together determine the best way forward, whether that be continuing in a modified way or discontinuing. We would also strongly recommend you seek advice from an appropriately qualified professional before you attend an in-person Event or purchase an Online Course to determine whether such activities would be appropriate for your condition. 


You will get the most out of working with us if you are open to both challenging and changing the way in which you live your life, are prepared to take personal responsibility for your health, wellbeing and actions, and then to do the subsequent work required to effect the changes you would like to see happen.


You might not be a good fit for the work we offer on Events if you have an acute or chronic health condition that may potentially be aggravated by your attendance on Events. We suggest you seek professional advice to firstly determine whether any of these may be suitable and also to be very honest with yourself about the reality of your situation, despite the willingness in your mind.


Content Errors

We do not make any guarantees or warranties about the accuracy of any material displayed on the Website or on Events, except for any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law. We are human, and errors can creep in and be missed despite the best of intentions. If you see something that doesn’t seem right, please let us know so we can rectify.

Loss Or Damage

While we make all reasonable efforts to ensure that the Website and our Events meet with the highest standards of best practice, if something does go wrong that is not a direct result of our negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, we will not be liable for any loss or damage arising out of or related to our Events and Website, any products or services purchased through it, or any material posted on it, irrespective of whether such damages were foreseeable, and regardless of the nature of the claim.

Liability For Advice

You take full responsibility for your implementation of any practices, suggestions or advice that we may make while providing our services. You understand that our advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take in regards to that advice. Always consult your own values and instinct, do your own research, and check with appropriately qualified professionals before making any major decisions or making significant changes in your life. You agree to indemnify us against all consequences arising directly or indirectly from your choices.

Cap On Damages

You expressly agree that if this indemnity is unenforceable for any reason, our total cumulative liability for all causes of action of any kind shall not exceed the amount that you have paid to us.

Payment Terms

All prices on our Website/s are in Australian dollars and are not subject to GST.

All payments made through the Website are processed using Stripe. We do not have access to any of your account details. Any financial information you enter is stored under Stripe’s security policy at https://stripe.com/docs/security/stripe.

Payment Terms

Payment is due within 14 days from the date on our invoice or at least 3 business days before the start date of an Event.

If we have not received payment for an invoice after 14 days, we will send you a reminder. We will continue to send weekly reminders after that until payment is received. After the first reminder, an administrative fee of $20.00 will be added to the total amount due for every reminder sent. This is because having to nag  you for my payment is not pleasant. If there is a problem with payment, please contact us as soon as possible to make alternative arrangements and avoid incurring this  administrative fee. 

Payment Plans

Payment plans are offered for your convenience only, so you can spread your payment out over time. You are still committed to paying the whole amount, even if you change your mind about your purchase. It is your responsibility to ensure you have sufficient funds to make payment installments on time and full payment must be made 3 business days prior to an Event.

Debt Collection

If an invoice is more than 28 days overdue, you agree to pay all costs, including debt collection agency fees and solicitor’s costs, that we may incur in taking steps to recover any money that you owe to us, regardless of whether legal proceedings are issued in relation to the debt.

Refund Policy

Change of Mind

We want to be sure you are happy with your purchase so we offer a refund of the full amount less a 5% bank processing fee if you change your mind within 24 hours of your payment being made.


The planning and running of all Events requires a lot of time and energy in order to provide them. As such we need to factor that time into the running of the Events and cancellations, although often unforeseen mean we do not get paid for that work. Full payment for all Events and Online Courses are required to be made at the time of purchase. In the event that you need to cancel your booking, the following conditions apply unless stated otherwise in specific Event Terms and Conditions;

  • 7 days prior to the Event starting; No refund is available unless your place can be filled from our waiting List. In that case you will get a full refund less a 15% administration fee.
  • between 7-21 days prior to the Event starting; You will get a 50% refund unless your place can be filled from our waiting List. In that case you will get a full refund less a 15% administration fee.
  • more than 21 days prior to the Event starting; you will get a full refund less a 15% administration fee
Consumer Guarantees

Limitation Of Liability

We take our obligations under Australian Consumer Law seriously and will do our best to address any issues that arise. However, even if there is a major problem, our liability is strictly limited to:

  • replacing the goods or providing the services again; or
  • if we are unable to do so within a reasonable time, refunding the full amount that you have paid to us.

Invitation To Discuss Problem

If you feel that there is any problem with our services/your purchase, please let us know within 24 hours before the end of the session. We are keen to understand what has gone wrong if you are unhappy so that we can address your concerns and try to find a mutually acceptable solution.

Appointment Policies

If you are unable to attend a scheduled appointment, please give us at least 12 hours’ notice so we can potentially fill that appointment slot. We can reschedule the appointment to a time that suits. In the case of an unplanned emergency, please advise us at your earliest possible convenience.

If we are unable to attend a scheduled appointment or meeting, we will provide the same notice and work with you to reschedule the appointment to a mutually convenient time. 

Intellectual Property

Copyright & Trade Secrets

All Content on the Website, in our courses, such as text, data, graphics files, videos and sound files, and other materials contained in them, are protected by copyright laws and treaties around the world, with all rights reserved unless otherwise noted, and are the property of Tara Springs Pty Ltd and/or a supplier to Tara Springs. No such materials may be used except as provided in these Terms and Conditions.

You may not copy or reproduce any part of our publicly available Content without our written consent. You may store, print and reproduce the publicly available Content that we supply solely for your own personal use, and only if we are clearly acknowledged as the source. 

If you are participating in our courses, Content may be printed or downloaded to a local hard disk strictly for your personal and non-commercial use. Course content represents a synthesis of all our collective experience, training and learnings that are offered exclusively to participants. It is an essential condition of participation that you agree that you will not provide extracts of any course Content to anyone else without explicit written consent.

Commercial exploitation of our content in any way that competes with our business is strictly prohibited.

You may link to content on our Website or social media profiles, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Trade Marks

We own Tara SpringsTM, Jane Mallick YogaTM, Glenn Polley ShiatsuTM, their associated logos, and service marks displayed on the Websites. These trademarks may not be used in connection with any other product or service without our express permission, or in any way that is likely to cause confusion in the marketplace, or in any manner that disparages us or our business. 

Respectful Communication

Comments Policy

We reserve the right to moderate any comments made on the Website, in the Facebook Groups we control, and on any of our social media pages and profiles, including deleting comments that we deem to be rude, offensive, spammy or unacceptable, without any notification or correspondence with you. Keep all communication kind and polite, please.

Responsible Engagement

Disrespectful or aggressive behaviour towards our team or anybody else will not be tolerated. 


If a dispute arises, everyone involved agrees that they will not engage in any public discussion about the issues, will behave politely towards each other, and will avoid any conduct or communication which might reasonably be expected to interfere with each other’s business or personal interests.

Dispute Resolution & Jurisdiction


If you have any concerns, issues, or complaints arising out of your use of the Websites, our products or services, or these terms and conditions, you agree to communicate with us with the intention of making a genuine effort to find a win/win solution and seeking to resolve the dispute in good faith through negotiation and discussion. Please email us at admin@tarasprings.com.au and expect a response within 7 business days. 


If the dispute cannot be resolved by negotiation and discussion within 14 days, we suggest you take up your complaint with the Victorian Health Complaints Commissioner.

These Terms & Conditions are subject to the governing law of the State of Victoria, Australia. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Victoria, and the Commonwealth of Australia, will have exclusive jurisdiction.
